Resale Certificate

A resale certificate and copy of a community's governing documents are part of the package of paperwork that is exchanged during the process of buying or selling a home. The resale certificate provides transparency about the community and the seller's financial obligations to the association.

HOA bylaws are governing guides. Bylaws are supposed to be about the government of the corporation. They should cover things like how often you have meetings, how many people are on the board, how often you have to have membership meetings, and what's a from this item’ in the edit panel.

Articles of Incorporation

Covenants, Conditions and Restrictions

The Declaration of CC&Rs is the legal document that lays out the guidelines for the planned community. The CC&Rs are usually recorded in the county records in the county where the property is located and are legally binding. When you purchase a lot or a home in a planned community, in most cases, you'll automatically become a member of the HOA.
Basically, the CC&Rs are the rules of your neighborhood. They govern what you can, can't, or must do with respect to your home.

Meeting Minutes

The official record of the proceedings of a meeting, and generally recorded by the secretary of the HOA or appointed scribe.


Resolutions are the most formal way, aside from modifying the recorded HOA documents, that the association can enact procedures for the management of the HOA.
